dc.description.abstractEs propósito dentro del Semillero Fenomenología Jurídica Narrativa, realizar reflexiones ius-filosóficas respecto a los conceptos y dilemas problemáticos que se presentan a través del devenir jurídico. Es por esto que se parte desde una perspectiva fenomenológica-hermenéutica en aras de lograr una descripción profunda del concepto estudiado. Siendo así, y al partir de un enfoque fenomenológico, se quedaría corto sim-plemente describir la problemática que envuelve el objeto de estudio, por tanto lo que se pretende es abordar los conceptos desde la narrativa, no literaria, sino más bien la narrativa histórico-descriptiva. Así pues, pretende el presente escrito mostrar la actuación de la Corte Constitucional al declarar el estado de cosas inconstitucional como una manifestación de lo que Michael Foucault llamaría parrhesía. Pues, al tener la Corte el coraje de evi-denciar la inoperatividad Estatal en cuanto a la protección de derechos constitucionales, deja de manifiesto que estos mismos y la propia justicia son más ideas que realidades dentro del Estado Social de Derecho.en_ES

dc.description.abstractengThe Narrative Phenomenology of Law seed breeding intends to make iusphilosophic reflexions on problematic concepts and dilemmas that emerges through juridical becoming. That is the reason for which a phenomenologic and hermeneutical perspective is proposed as a methodological an conceptual foundation, oriented to achieve an in-depth description of the concept which is being studied. Thus, and from a phenome-nologic point of view in methodology, a mere description of the object under research –if its complexity is taken into account– falls short with only describing what the problem is about, which obligues the methodology to assume a non-literary historical-descriptive narrative. This paper intends, then, to show that the Constitutional Court Act, in declaring the Inconstitutional State of Things, is a manifestation of what Michel Foucault calls parrhesía, for, in having the courage of make evident the Statal inefficiency respecting de protection onf cons-titutional rights, unvelis that those same rights and Justice herself are more ideas than realities into the Social State of Right.en_ES
