dc.description.abstract | El presente artículo expone, a través de una interpretación histórica, las razones por las cuales el régimen fascista alemán, que ostentó el poder entre los años 1933 a 1945, se aleja completamente de las corrientes ideológicas de izquierda, en específico, de la socialdemocracia y del comunismo, presentes en el escenario político de ese periodo, ubicándose por el contrario en un paradigma plenamente de ajustado al concepto de extrema derecha. Para sostener esta afirmación, se presenta un conjunto de evidencias históricas de peso, que dejan ver en primera medida cómo el proceder del partido nazi se vio respaldado por los sectores más conservadores de la época, quienes se benefi-ciaron del régimen y vieron en él reflejadas sus aspiraciones ideológicas. Así mismo se evidenciará cómo el régimen se valió su posición en el gobierno alemán para censurar y perseguir en el terreno jurídico, a los sectores de izquierda durante todo el tiempo que ostentó el poder. En última medida se analiza como a través de imposiciones legales adoptadas durante la dictadura, se vulneraron construcciones jurídicas que contribuían a la consolidación del Estado de derecho, la primacía constitucional y a la democracia deliberativa. Para la construcción de los postulados de este escrito, se analizaron tanto leyes de la época como el manifiesto ideológico del líder del partido nazi, contrastado con la interpretación de varios juristas, filósofos e historiadores. | en_ES |

dc.description.abstracteng | This article exposes, through a historical interpretation, the reasons why the German fascist regime, which held power between the years 1933 to 1945, moves completely away from the ideological currents of the left, In particular, the Social Democracy and Communism, present in the political scene of that period, situating themselves instead in a paradigm fully adjusted to the concept of the extreme right. To support this statement, a set of important historical evidences is presented, which show in the first place how the Nazi party’s actions were supported by the most conservative sectors of the time, those who benefited from the regime and saw its ideological aspirations reflected in it. It will also be evident how the regime used its position in the german’s government to censor and persecute in the legal field, the leftist sectors during the entire time it held power. In the final analysis, it is analyzed how, through legal impositions adopted during the dictatorship, legal constructions that contributed to the consolidation of the rule of law, constitutional primacy and deliberative democracy were violated. For the construction of the postulates of this writing, we analyzed both the laws of the time and the ideological manifesto of the leader of the Nazi party, contrasted with the interpretation of several jurists, philosophers and historians. | en_ES |
