LA DEFENSA TÉCNICA EN EL PROCESO DISCIPLINARIO

Abstract

El derecho de defensa como garantía procesal y debido proceso, tiene base constitucional en el artículo 29. Permitiendo la participación del inculpado, mediante medios para su defensa. Se intenta reconocer la importancia de la defensa técnica de funcionarios públicos designados como defensores de oficio aun sin ser abogados. Se extrae información jurídica, legal, constitucional y jurisprudencial que permitan reconocer dicha defensa en estos casos; entendiendo la facultad otorgada a estudiantes de los consultorios jurídicos cuando adquieren personería jurídica de defensores técnicos, siendo el Ministerio de Justicia y del Derecho entes de control, vigilancia y seguimiento disciplinario de sus actuaciones. Se busca investigar desde el régimen disciplinario la forma como debe garantizarse su actuación, sanciones aplicadas e implicaciones de la posible deficiencia.

The right to defense as a procedural guarantee and due process has a constitutional basis in Article 29, which allows the participation of the accused, through means for his defense. An attempt is made to recognize the importance of the technical defense of public officials appointed as public defenders even if they are not attorneys. Legal, legal, constitutional and jurisprudential information is extracted in order to recognize such defense in these cases; understanding the power granted to students of law offices when they acquire legal status as technical defenders, being the Ministry of Justice and Law entities of control, surveillance and disciplinary monitoring of their actions. An attempt is made to investigate from the disciplinary regime the way in which their performance must be guaranteed, sanctions applied and implications of the possible deficiency.
