El rol de la personería municipal en el nuevo Código General Disciplinario

Abstract

La reciente expedición de la Ley 1952 de 2019, modificada por la Ley 2054 de 2021, llama la atención en lo que al papel de las personerías municipales se refiere, teniendo en cuenta las novedades introducidas al control preferente que en materia disciplinaria se les asigna. Es por ello que resulta necesario, de forma inicial, revisar los postulados de las normas previamente citadas, para dilucidar las novedades del rol del personero municipal en el proceso disciplinario, pasando a reconocer las diferencias existentes entre el papel desempeñado por la Procuraduría y el desempeñado por la Personería en materia disciplinaria; finalizando con la identificación del alcance del control preferente y la naturaleza de las decisiones adoptadas por los personeros municipales en el desarrollo de su función disciplinaria que se vio fortalecido con la normatividad vigente.

The recent issuance of Law 1952 of 2019, modified by Law 2054 of 2021, draws attention to the role of municipal ombudsmen, taking into account the novelties introduced to the preferential control assigned to them in disciplinary matters. That is why it is necessary, initially, to review the postulates of the aforementioned norms, to elucidate the novelties of the role of the municipal ombudsman in the disciplinary process, going on to recognize the differences between the role played by the Attorney General's Office and that played by by the Ombudsman in disciplinary matters; to finish by identifying the scope of preferential control and the nature of the decisions adopted by the Municipal Representatives in the exercise of their disciplinary function that was strengthened with the current regulations.
