Esta investigación, tiene como propósito analizar el parágrafo 1 del artículo 23 del título VI del proyecto de ley de la reforma laboral en Colombia, el cual estableció la prohibición de la cláusula de exclusividad contractual para el trabajo en plataformas digitales de reparto, dicha prohibición tiene su lado desafiante a la hora de confrontarlo con el Sistema de gestión de la seguridad y salud en el Trabajo, puesto que existe una
dificultad aplicativa, de identificación, gestión de riesgos ocupacionales, y además se halla una ambigüedad en la determinación de la responsabilidad cuando se está frente a un accidente o enfermedad de trabajo. En consecuencia, se analizará la aplicación de la cláusula de exclusividad frente al trabajo en plataformas digitales de reparto, confrontando la normativa actual de seguridad y salud en el trabajo, y la identificación
de los riesgos de los trabajadores digitales en Colombia.
This research aims to analyze paragraph 1 of article 23 of Title VI of the labor reform bill in Colombia, which established the prohibition of the exclusivity clause for work on digital delivery platforms. This prohibition presents challenges when confronted with the Occupational Health and Safety System, as there are difficulties in its application, identification, and management of occupational risks, as well as ambiguity
in determining responsibility in the event of an accident or work-related illness. Consequently, the application of the exclusivity clause regarding work on digital delivery platforms will be analyzed, comparing it with current occupational health and safety regulations, and identifying the risks faced by digital workers in Colombia.
