El presente artículo referente a los contratos tipo bolsa o de monto agotable en las entidades
estatales nace de la información encontrada en el ejercicio de la contratación adelantada por
las entidades estatales de los diferentes órdenes territoriales en el país, que en repetidas
ocasiones los usan para adquirir bienes, servicios y obras que deben ser adquiridos mediante
otras figuras y modalidades contractuales ya estipuladas en la gestión contractual, lo que
conlleva a incurrir en sobrecostos no acordes a los mercados locales, con oferentes no calificados y con deficiencias en calidad de bienes y servicios; lo que implica también para
los servidores públicos responsabilidades legales, no por desconocimiento de la normativa
colombiana sino por el facilismo que este tipo de contrato ofrece.
Para este análisis fue usado el método experiencial basado en el modelo clásico de la
experiencia- reflexión-generalización y transferencia diseñado por David Kolb (1984) y se
desarrolla en dos capítulos, generando como principal conclusión que si bien es cierto este
tipo de contrato no está prohibido en la contratación estatal colombiana, tiene un campo de
acción muy reducido y debe de ser lo suficientemente justificado y detallado en su uso, por lo
que no es aplicable al general de las adquisiciones de las entidades estatales.
This article on stock exchange agreement or exhaustible amount contracts in state entities arises from the information found in the procurement exercise carried out by state entities of

due to a lack of knowledge of Colombian regulations, but because of the ease with which this type of contract offers For this analysis the experiential method was used based on the classic model of experiencereflection-generalization and transfer designed by David Kolb (1984) and is developed in two chapters, generating as main conclusion that although it is true that this type of contract is not
prohibited in the Colombian state procurement, it has a very limited field of action and must be sufficiently justified and detailed in its use, so it is not applicable to the general procurement of state entities.
