Juicio De Adecuación En Las Faltas Gravísimas Relacionadas Con La Violación Al Derecho Internacional De Los Derechos Humanos En La Ley 1952 De 2019

Abstract

Se pretende establecer cuáles son los tratados internacionales que debe tener presente la autoridad disciplinaria al momento de tipificar una falta gravísima por violación al Derecho Internacional de los Derechos Humanos. Este artículo se desarrolla, en primer lugar, abarcando la tipicidad en materia disciplinaria y la connotación que trae para esta área particular del derecho sancionador. Posteriormente, se señala cómo ingresan los tratados internacionales de derechos humanos al ordenamiento jurídico colombiano. En tercer y cuarto lugar, se realiza un rastreo de cuáles tratados son vinculantes para Colombia y que hacen parte del Sistema Universal e Interamericano de Derechos Humanos. Finalmente, se establece el imperante requerimiento que tiene la autoridad disciplinaria de conocer toda la normativa internacional al momento de establecer si una conducta es típica por violación a los Derechos Humanos

The purpose of this text is to establish which are the international treaties that the disciplinary authority must take into account at the time of typifying a serious offense for violation of International Human Rights Law. This article is developed, in the first place, covering the typicity in disciplinary matters and the connotation it brings to this particular area of punitive law. Subsequently, it indicates how international human rights treaties enter the Colombian legal system. Thirdly and fourthly, a review is made of which treaties are binding for Colombia and which are part of the Universal and Inter-American Human Rights System. Finally, it establishes the imperative requirement that the disciplinary authority has to know all the international norms at the moment of establishing whether a conduct is typical for violation of Human Rights
