Esta investigación se centra en analizar y explicar la trascendencia de los Hechos Disciplinariamente Relevantes ( a partir de ahora: HDR) plasmados por el operador disciplinario en el auto de Investigación Disciplinaria y su alcance en materia de congruencia con el auto de Pliego de Cargos, con relación a la entrada en vigencia de Código General Disciplinario modificado por la Ley 2094 de 2021, por medio del cual se establece que en la formulación de Investigación Disciplinaria se deben plasmar (entre
otros requisitos) la relación clara y sucinta de los hechos disciplinariamente relevantes en lenguaje comprensible,. Este novedoso presupuesto descrito en el numeral 2do del artículo 215 de la Ley
1952, plantea un enorme reto para el operador disciplinario, dado que lo somete a definir en los momentos primigenios del curso procesal, todo el marco sobre el cual realizará la Investigación, desarrollará su programa probatorio y eventualmente edificará una decisión de fondo, lo cual resulta abiertamente problemático si se tiene en cuenta que en su mayoría, las noticias con vocación disciplinaria que se allegan a los despachos, carecen de profundidad fáctica y que el establecimiento de los Hechos Jurídicamente Relevantes, se
convertirá en el marco no solo del curso procesal sino también en los presupuestos facticos jurídicos sobre los cuales el Investigado edificará su teoría defensiva e incluso podría asumir responsabilidad mediante la figura de la confesión. Por medio de la confrontación entre el Código Único Disciplinario y el Código
General Disciplinario se buscará establecer que variaciones se dieron con este cambio
normativo, los beneficios y consecuencias que acarrea la descripción de los hechos
disciplinariamente relevantes frente a la garantía del debido Proceso del investigado.
This investigation focuses on analyzing and explaining the significance of the disciplinary relevant facts embodied by the disciplinary operator in the Disciplinary Investigation order and its scope in terms of consistency with the Order of Charges, in relation to the entry into force of the Code General Disciplinary Law modified by Law 2094 of 2021, by means of which it is established that in the Disciplinary Investigation
formulation, the clear and concise relationship of the disciplinary relevant facts must be reflected (among other requirements) in understandable language. This new budget described in the numeral 2nd of article 215 of the 1952 law, poses an enormous challenge for the disciplinary operator, since it submits him to define in the original moments of the procedural course, the entire framework on which the Investigation will be carried out, will be developed. its evidentiary program and will eventually build a substantive decision, which is openly problematic if one takes into account that most of the news with a disciplinary vocation that reaches the offices lacks factual depth and that the establishment of the Facts Legally Relevant, it will become the framework not only of the procedural course but also in the factual legal assumptions on which the Investigated will build his defensive theory and could even assume responsibility through the figure of the confession. Through the confrontation between the Single Disciplinary Code and the General Disciplinary Code, it will seek to establish what variations occurred with this regulatory change, the benefits and consequences that the description of the disciplinary relevant facts entails against the guarantee of due process of the investigated.
