En el derecho laboral existen a favor del trabajador derechos que la ley y la doctrina consideran ciertos e
indiscutibles, que no pueden ser transados ni renunciados por el trabajador, y que son especialmente protegidos por la ley, como el salario, las prestaciones sociales, la seguridad social, las horas extras, recargos nocturnos, dominicales, festivos, las vacaciones y los derechos que contempla el código sustantivo del trabajo.
La Sala Laboral de la Corte Suprema recordó que su carácter impide que sean materia de transacción o de
conciliación, además surgen del cumplimiento de los supuestos de hecho o de las condiciones establecidas en una norma jurídica. La jurisprudencia de la Corte Suprema señala que son derechos ciertos e indiscutibles aquellos sobre los cuales no hay duda alguna respecto a la existencia de los hechos que le dan origen y existe certeza de que no hay ningún elemento que impida su configuración o su exigibilidad.
Los efectos que acarrea cuando se concilian derechos ciertos e indiscutibles son revocar la Sentencia y dejarla sin efecto, así mismo la conciliación hace tránsito a cosa juzgada respecto a los hechos conciliados, de modo que ninguna de las partes pueda reclamar de nuevo sobre derechos ya conciliados.
In labor law, there are rights in favor of the worker that the law and doctrine consider true and indisputable, that
cannot be compromised or waived by the worker, and that are especially protected by law, such as salary, social benefits, social security, overtime, surcharges at night, Sunday, holidays, vacations and the rights that contemplate the substantive labor code. The Labor Chamber of the Supreme Court recorded that their nature prevents them from being a matter of transaction or conciliation, in addition they arise from compliance with the assumptions of fact or from the conditions established in a legal norm. The jurisprudence of the Supreme Court indicates that certain and indisputable rights are those about which there is no doubt regarding the existence of the facts that give rise to them and there is certainty that there is no element that prevents their
configuration or enforceability. The effects that it entails when certain and indisputable rights are reconciled are to revoke the Judgment and leave it without effect, likewise the conciliation makes transition to res judicata with respect to the reconciled facts, so that neither party can claim again on rights already reconciled.
