Este trabajo aborda el escenario constitucional de un derecho colectivo como lo es el espacio público, desde la perspectiva de la obligación que tiene la administración pública de mantener su integridad y garantizar su goce a toda la población, de conformidad con el artículo 82 de la Constitución Política Colombiana. Con el estudio de este escenario constitucional se busca evidenciar que con una interpretación errónea
del cumplimiento de la obligación mencionada, la administración pública puede vulnerar los derechos fundamentales al trabajo (art. 25 C.P.), al mínimo vital (Sentencia SU 995 Corte C.), al debido proceso (art. 29 C.P.), así como quebrantar el principio de confianza legitima de los vendedores ambulantes y/o estacionarios. Todo esto, cuando no generan las políticas públicas necesarias que permitan la garantía de sus derechos
fundamentales.
This work addresses the constitutional scenario of public space, from the perspective of the obligation that the public administration has to maintain its integrity and guarantee its enjoyment to the entire population in accordance with article 82 of the Colombian Political Constitution. The study of this constitutional scenario seeks to demonstrate that with compliance with the aforementioned obligation, the public administration can violate the fundamental rights to work (art. 25 C.N.), to the minimum vital (Sentence SU 995 Court C.), to due process (art. 29 C.N.), as well as violating the principle of legitimate trust of street and/or stationary vendors, when they do not generate the necessary public policies that allow the guarantee of their fundamental rights and legal security
