Los principios y normas rectoras que rigen el derecho disciplinario, se fundan en el respeto de la dignidad humana, por ende, en derechos fundamentales principalísimos como lo son; el debido proceso, la legalidad, proporcionalidad, igualdad, favorabilidad, entre otros, los cuales, solo buscan que el proceso disciplinario sea lo más garantista posible, partiendo siempre de la presunción de inocencia.
La subjetividad que reviste lo que establece específicamente el artículo 9° de la Ley 1952 de, modificada por la Ley 2094 de 2021, podrían ir en contravía de muchos de los derechos y principios, no solo legales, sino constitucionales, ya que este le deja, tanto al que investigue la falta o conducta del disciplinado, como al que la juzga, la libre interpretación al momento de adecuar la ilicitud sustancial que pueda derivarse del hecho investigado.
