El propósito central del presente artículo se basa en analizar el ejercicio de la prerrogativa estatuida en el artículo 225D numeral 4 del C.G.D., mediante la cual se permite la variación de cargos y su debida notificación por parte del funcionario de Juzgamiento, y si con ello se pierde competencia por parte de éste para emitir fallo; se procura además, analizar si profiriendo el mismo se estarían vulnerando los principios de imparcialidad objetiva y la garantía de independencia, y el debido proceso en el marco del artículo 12 de la ley 1952 de 2019, en convergencia con la sentencia de 8 de julio de 2020, emitida por la Corte Interamericana de Derechos Humanos en el caso Petro Urrego Vs Colombia.
