La Corte Interamericana de Derechos Humanos declaró al Estado Colombiano responsable internacionalmente por la afectación de derechos políticos del ciudadano Gustavo Petro Urrego respecto a la sanción disciplinaria dispuesta por la Procuraduría General de la Nación, vulnerando lo estipulado en el artículo 23.2 convencional, toda vez que, permitió que una autoridad administrativa restringiera sus derechos políticos, olvidando el objeto y fin del instrumento de la sanción. El Estado Colombiano con el ánimo de subsanar dicha afectación procesal, expidió la Ley 2094 de 2021, donde atribuyó funciones jurisdiccionales con una extensión más amplia del sujeto activo de la falta disciplinaria, incluyendo los de elección popular, por lo que existe la tarea de determinar si dicha propuesta normativa se encuentra ajustada a la Convención , a través de un estudio de caso, pronunciamiento jurisprudencial y doctrinal, analizando la realidad jurídica desde el bloque de constitucionalidad, la principialística, la dogmática y ponderación de derechos.
The Inter-American Court of Human Rights declared the Colombian State internationally responsible for the violation of the political rights of citizen Petro Urrego with respect to the disciplinary sanction ordered by the Office of the Attorney General of the Nation, violating the provisions of article 23.2 of the Convention, since it allowed an administrative authority to restrict his rights, forgetting the object and purpose of the instrument of the sanction. The Colombian State, with the aim of correcting said procedural affectation, issued Law 2094 of 2021, where it attributed jurisdictional functions with a broader extension of the active subject of the disciplinary offense, including those of popular election, so there is the task of determining whether said normative proposal is in accordance with the Convention, Through a case study, jurisprudential and doctrinal pronouncement, analyzing the legal reality from the block of constitutionality, the principialistic, the dogmatic and weighting of rights.
