A partir de la década de los 70’s, algunas organizaciones criminales en Colombia alcanzaron amplias dimensiones de poderío económico, dejando al descubierto las falencias enormes que la legislación nacional ostenta por el hecho de dejar de lado la preocupación relativa a los efectos patrimoniales de las actividades ilícitas. En cuanto al aspecto metodológico, para el presente escrito se utilizó el enfoque cualitativo y el método documental. Ahora bien, en cuanto a los resultados, estos versaron sobre la naturaleza sancionatoria que ostenta la extinción de dominio, reconociendo la necesidad de la valoración de aspectos subjetivos en las causales de destinación ilícita o de adquisición de bienes de origen ilícito por terceros, sin que tengan alguna relación con la causal, por lo que, se reconoce la buena fe objetiva como un elemento subjetivo de la acción. Esta figura tiene todas las herramientas y las bases para dejar de ser tenida en cuenta como una acción o como un simple procedimiento especial y empezar a ser reconocida como una nueva juricidad de derecho sustancial, que permite que se protejan los derechos de propiedad y otros económicos conexos, por medio del

From the 70's, some criminal organizations in Colombia reached large dimensions of economic power, exposing the enormous shortcomings that national legislation holds for the fact of leaving aside the concern about the issue of the patrimonial effects of illicit activities. Methodology: qualitative approach, documentary method. Results: the sanctioning nature of the extinction of ownership recognizes the need for the assessment of subjective aspects in the causes of illicit destination or acquisition of assets of illicit origin by third parties, without having any relationship with the cause, therefore, objective good faith is recognized as a subjective element of the action. This figure has all the tools and bases to stop being taken into account as an action or as a simple special procedure and begin to be recognized as a new jurisprudence of substantial law, which allows property and other related economic rights to be protected, through the restoration of them.
